Claims of Obstructed Justice as Opposition Pursues Case Over Gachagua Attack

The United Alternative Government has announced plans to initiate private prosecutions over the Witima ACK Church attack and alleged assassination attempt on Rigathi Gachagua.

In a press statement on Thursday, the opposition outfit said it would no longer engage the Inspector General of Police, Mr. Douglas Kanja, accusing senior government officials of obstructing justice.

The group said it met the Inspector General at Jogoo House on January 30 regarding the violent attack at Witima ACK Church in Othaya and the attempted assassination of Second Deputy President Rigathi Gachagua.

“We left that meeting in good faith, believing that investigations would proceed independently and that justice would follow,” the statement read.

The statement was signed by Dr Fred Matiang’i, Rigathi Gachagua, Kalonzo Musyoka and Eugene Wamalwa.

However, the group claimed it was later informed that investigations had been concluded and that 12 police officers had been identified as perpetrators, alongside two Members of Parliament from Murang’a and Nyeri counties alleged to have financed the attack.

The statement further alleged that the investigative file, which was ready for transmission to the Director of Public Prosecutions (DPP), had been intercepted by Interior Cabinet Secretary Kipchumba Murkomen.

“We call this what it is: a criminal abuse of power. It is obstruction of justice,” the statement said. “CS Murkomen has, by this act, placed himself squarely on the wrong side of the Constitution, the law, and the Kenyan people.”

Citing Article 157 of the Constitution and provisions of the Office of the Director of Public Prosecutions Act and the Criminal Procedure Code, the group said it would proceed with private prosecutions.

“The law is on our side. The Constitution is on our side. The Kenyan people are on our side,” it said.

“The perpetrators of this cowardly act, and those who have moved to protect them, should be under no illusion: they will be held to account.”

The United Alternative Government also placed the Inspector General and the Kenya Police Service “on formal notice” not to interfere with its planned public gatherings, including a meeting scheduled in Nairobi on February 22.
